Welcome to ScratchAll! These Terms and Conditions ("Terms") govern your access to and use of the ScratchAll game, website, and all related services (collectively, the "Service"), operated by ScratchAll ("we," "us," or "our").

By creating an account or using our Service, you agree to be bound by these Terms and our Privacy Policy. Please read them carefully. If you do not agree to these Terms, you may not use the Service.

1. The Service

ScratchAll is a free-to-play entertainment service where users can play virtual scratch-off games. The Service is for entertainment purposes only. No real money can be won from playing the game. The Service may contain advertisements, such as inline ads.

2. Gameplay Mechanics

2.1. Ticket Activation and Cost: When a virtual scratch ticket is loaded for play, its potential prize outcomes are populated based on that specific ticket's predetermined odds. The cost of the ticket in Coins is deducted from your coin balance only when you begin to interact with (i.e., "scratch") the ticket.

2.2. How to Play: Players use their mouse or finger to virtually scratch the surface of the ticket to reveal prize values. After revealing the main play area(s), the player may scratch a final "Scratch to Cash" area to display the ticket's total prize value. The calculated value is still awarded to the user if they exit the game without scanning the ticket.

2.3. Prizes: Players can win virtual Coins from tickets. We may, at our discretion, introduce the ability to win other types of Virtual Items.

2.4. Ticket Variety: The Service features different types of virtual scratch tickets. These tickets may vary in their Coin cost, the range of possible prize values, minimum and maximum win amounts, and the odds of winning.

3. Eligibility

You must be at least 18 years of age to use the Service. If you are between the ages of 13 and 18, you may only use the Service with the permission and under the supervision of a parent or legal guardian who agrees to be bound by these Terms. The Service is not intended for children under the age of 13.

4. User Accounts

4.1. Account Creation: To access certain features of the Service, you must create an account. You agree to provide accurate and complete information and to keep this information updated.

4.2. Account Security: You are responsible for safeguarding your account login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4.3. Usernames: Your username is your identity on our platform. You may not use a username that is profane, offensive, infringes on any third party's rights, or is intended to impersonate another person. We reserve the right, in our sole discretion, to change any username we deem inappropriate or to suspend or remove the associated account.

4.4. Account Transfers: The trading, selling, or transferring of accounts between users is strictly forbidden. Any attempt to do so may result in the immediate termination of the involved accounts.

5. Virtual Items

5.1. Definition: The Service may include virtual in-game items ("Virtual Items"). These include, but are not limited to:

  • Coins: The primary virtual currency used to purchase virtual Scratch Tickets or Cards. Coins can be won from tickets, received as daily bonuses, or acquired through other means within the Service.
  • Diamonds: A secondary virtual currency that may be exchanged for Coins at varying rates or used for other purposes within the Service.
  • Scratch Tickets/Cards: The virtual items used to play the core game.
  • Cosmetics and Boosters: Items that change the appearance of your game or provide temporary enhancements to gameplay.

5.2. No Real-World Value: Virtual Items are for entertainment purposes only and have no cash value or real-world equivalent. They cannot be redeemed for real money, goods, or services from us or any other party. You agree that you have no property interest in any Virtual Items.

5.3. Limited License and Revocation: When you acquire Virtual Items, you are obtaining a limited, non-transferable, revocable license to use those Virtual Items within the Service. You acknowledge a distinction between Virtual Items acquired with real money ("Purchased Items") and those acquired through gameplay, winnings, daily bonuses, or promotions ("Earned Items"). We reserve the right to manage, regulate, control, modify, or eliminate Earned Items at any time, with or without notice, at our sole discretion, and we will have no liability to you for such actions. This includes the right to revoke any Earned Items, particularly in cases of suspected cheating or exploitation. Purchased Items will not be revoked except in verified cases of fraud, payment refunds/chargebacks, or a material violation of these Terms.

5.4. Bonuses: We may offer a fixed daily bonus of Coins. We may also offer additional bonuses, which may be random or targeted to specific players or groups of players. All bonuses are considered Earned Items and are subject to the terms in Section 5.3.

6. Purchases and Payments

6.1. The Shop: You may purchase a license to use certain Virtual Items through our in-game "Shop" using real money. This may include "Coin Packs," "Content Packs," "Feature Packs," "Boosts," "Bundles," or "Stashes," (expression may vary) containing a combination of Virtual Items.

6.2. Payment Processing: All real-money transactions are processed through our third-party payment processor, Stripe. By making a purchase, you agree to abide by Stripe's own terms and conditions. We do not receive or store your full financial information.

6.3. All Purchases Final: You acknowledge that all purchases are final and non-refundable. We are not required to provide a refund for any reason. If you believe your account has been charged in error, you must contact us within 30 days. Refunds for such errors will be considered on a case-by-case basis and granted at our sole discretion.

6.4. Promotional Pricing: We may offer promotional pricing, discounts, or special offers from time to time. Such offers may be available only to specific users or for a limited time. We are not obligated to offer you any particular promotion or the lowest available price at any given time.

7. User Conduct

You agree not to do any of the following while using the Service:

  • Use cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party software designed to modify or interfere with the Service.
  • Exploit any bug or glitch in the Service for personal gain.
  • Violate any applicable law or regulation.
  • Harass, threaten, bully, embarrass, or do anything else to another player that is unwanted, such as repeatedly sending unsolicited messages.
  • Post or share any content that is abusive, threatening, obscene, defamatory, libelous, or racially, sexually, religiously, or otherwise objectionable or offensive.
  • Attempt to disrupt or overburden our servers or networks.

Violation of these rules of conduct may result in the suspension or termination of your account at our discretion.

8. Intellectual Property Rights

8.1. Our Content: The Service and all of its components, including the user interface, game mechanics, software code, branding, and logos ("Our Content") are the exclusive property of ScratchAll and its licensors. You agree not to copy, modify, distribute, sell, or lease any part of Our Content.

8.2. Third-Party Content and Takedown Notices: Certain visual assets or characters displayed within the Service are for illustrative and parody purposes only. Ownership and all rights to these existing assets remain with their respective rights holders. You may not reproduce these digital assets. 9. Referral Programs

From time to time, we may offer referral programs that allow you to invite friends to join the Service in exchange for rewards, such as Coins or other Virtual Items. A "Qualified Referral" is typically defined as a new user who creates an account through your unique referral link or by using your referral code. Specific programs may require the referred user to achieve certain in-game milestones before full referral rewards are granted. The precise terms and rewards for each referral program will be detailed within that program's specific rules.

10. Leaderboards and Competitions

The Service may feature leaderboards that display user-generated usernames along with various statistics about a player's virtual experiences and balances. We may also run competitions tied to these leaderboards. Competition leaderboards typically reset at the end of the competition period and may award Virtual Items as prizes to top-ranking players. All our decisions regarding competitions and prizes are final.

11. Termination and Suspension

We reserve the right to suspend or permanently terminate your account and your access to the Service, at our sole discretion and without notice, if we determine that you have violated these Terms. In the event of account termination, you will forfeit all Virtual Items associated with your account, and you will not be entitled to any refund or compensation. Our goal is to ensure a safe and fair environment, and we will take actions we believe are appropriate to maintain it.

12. Dispute Resolution by Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR RIGHTS. By agreeing to these Terms, you and ScratchAll agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be determined by binding arbitration, not in a court of law.

12.1. Arbitration Agreement: You and ScratchAll agree to arbitrate all disputes. Arbitration is more informal than a lawsuit in court and uses a neutral arbitrator instead of a judge or jury.

12.2. Class Action Waiver: YOU AND SCRATCHALL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

12.3. Procedure: The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in Pittsburgh, Pennsylvania, or another mutually agreed location.

13. Governing Law

These Terms and any action related thereto will be governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of laws provisions.

14. Disclaimers and Limitation of Liability

14.1. Disclaimer of Warranty: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

14.2. Limitation of Liability: To the fullest extent permitted by law, ScratchAll shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.

15. Indemnification

You agree to indemnify and hold harmless ScratchAll and its employees, officers, directors, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, or your violation of these Terms.

16. Updates to These Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by updating the "Last Updated" date at the top of this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
